A man arrested in a drug raid Dec. 22, 2008, has filed suit seeking judicial review of a decision to deny him unemployment.

Filemon Ortiz, 5125 E. Minooka Road, filed the suit in circuit court Friday, against the Illinois Department of Employment Security.

Agents from the Drug Enforcement Agency and Grundy County deputies raided the property at 5125 E. Minooka Road on Dec. 22 and seized 300 pounds of marijuana and 172 grams of cocaine.

Ortiz was one five men arrested on drug charges and held in lieu of $50,000 bail.

According to the complaint, Ortiz had someone call Graphic Packaging on Armstrong Street and tell them he would not be at work because of an emergency.

Ortiz said he did not tell them he was in jail because he was innocent.

On Jan. 12, when he returned to work, Ortiz said he was told that if he resigned, Graphic would not fire him for misconduct and he could collect unemployment

The complaint said Ortiz did not leave the job voluntarily and has not been convicted any crime, therefore he should be entitled to unemployment.

A hearing officer rejected his appeal of the department's decision to deny him unemployment.

Criminal charges against Ortiz are pending.

Matthew Hill, 17, 250 Second, Coal City, was placed on supervision for one year and fined $850 for possession of drug paraphernalia. He was charged June 8 at his residence.
