Lawsuit over fall from hydraulic basket dismissed

A suit filed by a man injured while working for a tree service has been dismissed in circuit court for lack of prosecution.

Andrew Garcia filed the suit June 11, 2009, against Dan Grogan, doing business as Grogan Tree Service, Beyer Road.

The complaint charged on March 28, 2009, Garcia was working for Grogan when he fell from a hydraulic basket and suffered serious injuries, including a broken left knee cap.

Garcia charged Grogan did not have worker's compensation insurance and sought damages for his injuries.
