Area couple sues over floor damages
A rural Morris couple has filed suit in circuit court seeking $60,000 in damages for wooden floors installed improperly at their residence at 2160 N. Buffalo Road.
Zach and Crystal Gibbons filed the suit against Carlisle Wide Plank Floors, seeking damages to cover the costs of replacing the floors.
According to the complaint in 2007, the plaintiffs contacted Carlisle about providing wood floors for the residence they were building along Buffalo Road.
After meeting with Gary Ryer, the suit charged, he recommended using Eastern white pine, despite being told the Gibbons had three large, active dogs.
On Sept. 4, 2007, 2,200 square feet of Eastern white pine was purchased and ultimately installed in the residence.
Despite following all the instructions, the suit charged, almost immediately after the floors were installed, the dogs caused scratches and gauges in the wood.
The complaint states Eastern white pine was an unsuitable wood to be used in a house with three dogs.
The Gibbons asked the court to award them $17,093, the amount paid for the original floor; $33,938, the cost of replacing the floor; $5,760 for living expenses, which will be incurred while the floor is being replaced; and other damages for a total of $60,172.
