State sues for payment of workman’s comp.

The state of Illinois is suing Eduardo and Israel Lopez for workman’s compensation pay the state has to pay due to an accident caused by Eduardo Lopez.

A man was killed and two state workers were injured May 9, 2011, after Eduardo Lopez, while driving in the parking lot of Stratton Park, struck the Illinois Department of Natural Resources tractor that the three victims were sitting in the bucket of while taking a break.

Eduardo Lopez has paid the medical bills and lost time of the two state workers, as has Israel Lopez, who was the owner of the vehicle Eduardo Lopez was driving.

The case file states Eduardo Lopez is responsible to pay any Workers’ Compensation Commission award of settlement for the two workers. Therefore the state is asking for Eduardo Lopez to pay $223,462.13 plus any other workman’s compensation.

It also asks the court to make Israel Lopez to pay any Workers’ Compensation Commission award or settlement.
