Freeport man re-sentenced for violating probation

A Freeport man was re-sentenced to 18 months in prison for violating his probation on a drug charge.

Brian Carey, 27, appeared in circuit court Tuesday, Oct. 27, and was sentenced on his Feb. 4 admission that he violated his probation. He was given credit for three days served. The sentence will run concurrently with one from Stephenson County.

He was originally arrested March 17, 2006, by Deputy Paul Clampitt for possession of cocaine.

On Nov. 9, he was placed on probation for two years, ordered to pay $780 in fees and assessment, submit a DNA sample and pay the $200 fee, complete 30 hours of community service work and submit to periodic drug tests.

On June 14, 2007, a petition was filed to revoke his probation, charging Carey had tested positive for cocaine use.

An amended petition to revoked his probation was filed Dec 20, 2007, stating he had been charged with two counts of domestic battery, criminal damage to property and disorderly conduct in Will County, in violation of his probation.

On Feb. 4, 2009, Carey admitted violating his probation. A pre-sentence investigation was ordered.
